Phi Learning Centre Co., Ltd. (operating the PHI Connections brand) respects your privacy and protects personal data in accordance with Thailand's Personal Data Protection Act B.E. 2562 (PDPA).

1. INFORMATION WE COLLECT

• School/centre contacts: name, email, phone, shipping address, school name, province
• Students/candidates incl. minors: name, date of birth, candidate number, school, grade, exam results (including verifying identity to view results/e-certificates online); for award recipients, a shipping address and phone number for delivering awards/certificates; for competitions paid directly to us, proof of payment
• User accounts (coordinators): name, email, login — to access the system
• Technical data: as needed to operate the website

2. PURPOSES & LEGAL BASES

• Registering/operating exam centres, running competitions, conducting exams, issuing results — performance of contract (s.24(3))
• Newsletters/announcements — consent (s.19), withdrawable anytime
• Publishing competition results and awardee lists (name, school, award/result) — consent (s.19), obtained at registration; raw scores and candidate numbers are not published publicly
• Minors — consent; children under 10 require parental consent (s.20). In the case of minors, this applies not only to those under 10 years of age — all minors under 20 years of age are required to obtain consent from their parent or legal guardian.

3. DISCLOSURE & SERVICE PROVIDERS

We use service providers (processors) under Data Processing Agreements: Wix (website), Google (documents/email), Supabase/Amazon Web Services (database), Vercel (hosting), JotForm (online forms, e.g., award shipping-address and payment-proof forms), and an email provider. Centres can only see their own candidates.

We may also disclose your personal data to the overseas competition organizers for the competitions you register for (see section 4): Aseeder (SEED ASDAN — organizer's agent in China), the KMT (Math Kangaroo) organizer in China, the MCE and JMMC organizers in Singapore, the ISO organizer in India, the SiL organizer in the United Kingdom, and the Hippo organizer in Italy.

4. CROSS-BORDER TRANSFER

Some providers host data abroad; transfers use lawful mechanisms (e.g., SCC or exemptions under s.28-29). For competitions with an overseas round, camp, or judging, one of two models applies (the lineup and model may change over time): (a) Register through us — we transfer the necessary data (e.g., name, email, school, grade, scores) to the overseas organizer on a lawful basis (your consent and/or service necessity), and this notice and our safeguards apply. (b) Register directly with the organizer — you submit your data on the organizer's own official website; we do not transfer it, and that organizer's own privacy policy and its country's laws apply, not this notice. This also covers online exams run on the organizer's platform (e.g., auto-proctored exams using camera, microphone and screen sharing): any video/audio captured during the exam is held by the organizer under its own policy; we do not record or keep copies. Each overseas organizer is an independent data controller under its own policies/laws, and the destination's protections may differ from Thailand's. Where a child travels to an overseas activity (e.g., a camp in China), we obtain parental consent before any transfer. Once we transfer on a lawful basis and after informing you, the organizer's subsequent processing is outside our control and responsibility. The list of competitions and which model applies is available on request.

We may transfer your personal data to overseas organizers to the extent necessary to fulfill the purposes for which the personal data was collected. Your personal data may be transferred to the following locations: China, Singapore, India, the United Kingdom, and Italy (depending on the competitions you register for). In the event that personal data is transferred to a country with a lower level of data protection compared to Thailand, we will take all appropriate steps to ensure that your data and privacy are protected in accordance with applicable legal obligations. Whenever we transfer your personal data, we will ensure that it receives a similar degree of protection by implementing one of the following safeguards: data processing/transfer agreements containing appropriate safeguards that enable the enforcement of data subject rights, or the consent of the data subject as well as other legal bases prescribed by applicable law.

5. RETENTION

We keep data only as long as necessary — generally 6 years after a competition cycle ends (covering continued participation across a full primary or secondary school span, and verification of past results and awards) — then delete or anonymize it.

6. YOUR RIGHTS

Access, copy, rectify, erase, restrict, object, data portability, and withdraw consent. Contact us below; we respond within 30 days.

Subject to the conditions and exceptions under the Personal Data Protection Act (PDPA), you have the following rights:
• Right of Access — Request access to and obtain a copy of your personal data, or request the disclosure of the acquisition of your personal data obtained without your consent.
• Right to Rectification — Request to rectify any inaccurate or incomplete personal data.
• Right to Erasure — Request the complete erasure of your personal data, including data that is no longer necessary for the purposes for which it was collected, data you have objected to or restricted the collection, use, or disclosure of, data collected, used, or disclosed unlawfully, and data for which you have withdrawn your consent.
• Right to Withdraw Consent — Withdraw your consent at any time. However, the withdrawal of consent shall not affect the collection, use, or disclosure of personal data that was lawfully conducted prior to the withdrawal.
• Right to Object or Restrict Processing — Object to or restrict the collection, use, or disclosure of certain types of personal data.
• Right to Data Portability — Receive your personal data in a format that is readable or commonly used by automated tools or devices and capable of being transferred, including requesting the direct transmission or transfer of your personal data to another organization.
• Right to Lodge a Complaint — Submit a complaint to the Personal Data Protection Committee (PDPC) if you believe your rights have been violated.

7. SECURITY

Appropriate technical and organizational measures per the PDPC's 2022 security notification (access control, authentication, least privilege, access logging).

We implement appropriate technical measures, administrative measures, and physical safeguards to prevent your personal data from unauthorized access, use, alteration, disclosure, or accidental loss. Furthermore, we restrict access to your personal data solely to authorized personnel on a need-to-know basis, and we have established procedures to report and handle personal data breaches. In addition, executives, employees, staff, contractors, agents, advisors, and recipients of data from us are obligated to maintain the confidentiality of personal data in accordance with the confidentiality measures set forth by the Company.

8. CHILDREN

For children under 20, data may only be provided with parental consent. If we find data was collected without proper consent, we will delete it.

If you are a minor according to Thai law, you must obtain the consent of your parents or legal guardian before giving us consent regarding data collection in accordance with the PDPA.

9. COOKIES

Our website uses cookies that are necessary for it to function, and may use analytics cookies provided by our website platform (Wix). You can manage or decline non-essential cookies via the cookie banner on the website or your browser settings.

1. ข้อมูลที่เราเก็บ

• ผู้ติดต่อศูนย์สอบ-โรงเรียน: ชื่อ-สกุล, อีเมล, เบอร์โทร, ที่อยู่จัดส่ง, ชื่อโรงเรียน, จังหวัด
• นักเรียน-ผู้เข้าสอบ รวมผู้เยาว์: ชื่อ-สกุล, วันเกิด, เลขประจำตัวผู้สอบ, โรงเรียน, ระดับชั้น, ผลสอบ (รวมการยืนยันตัวตนเพื่อดูผล/ใบประกาศออนไลน์) · ผู้ได้รับรางวัล: ที่อยู่และเบอร์โทรสำหรับจัดส่งรางวัล/ใบประกาศ · รายการที่ชำระตรงกับเรา: หลักฐานการชำระเงิน
• บัญชีผู้ใช้ (ครู/ผู้ประสานศูนย์): ชื่อ, อีเมล, บัญชี login — เพื่อเข้าถึงระบบ
• ข้อมูลทางเทคนิค: ตามที่จำเป็นต่อการให้บริการเว็บไซต์

2. วัตถุประสงค์และฐานทางกฎหมาย

• รับสมัคร-จัดตั้งศูนย์สอบ, จัดการแข่งขัน, จัดสอบ, ออกผล — ปฏิบัติตามสัญญา (ม.24(3))
• ข่าวสาร-ประชาสัมพันธ์ — ความยินยอม (ม.19) ถอนได้ทุกเมื่อ
• ประกาศผลการแข่งขันและรายชื่อผู้ได้รับรางวัล (ชื่อ โรงเรียน รางวัล/ผล) — ความยินยอม (ม.19) ขอไว้ในขั้นตอนสมัคร · ไม่เผยแพร่คะแนนดิบ/เลขประจำตัวผู้สอบต่อสาธารณะ
• ผู้เยาว์ — ความยินยอม; เด็กอายุต่ำกว่า 10 ปีต้องได้รับความยินยอมจากผู้ปกครอง (ม.20) ทั้งนี้ ไม่เฉพาะเด็กอายุต่ำกว่า 10 ปี ผู้เยาว์ที่อายุต่ำกว่า 20 ปีบริบูรณ์จำเป็นต้องได้รับความยินยอมจากผู้ปกครอง

3. การเปิดเผยและผู้ให้บริการ

เราใช้ผู้ให้บริการ (ผู้ประมวลผล) ภายใต้ข้อตกลงการประมวลผลข้อมูล (DPA): Wix, Google, Supabase/AWS, Vercel, JotForm (แบบฟอร์มออนไลน์ เช่น ที่อยู่จัดส่งรางวัล/หลักฐานชำระเงิน) และผู้ให้บริการอีเมล — ศูนย์สอบเห็นข้อมูลเฉพาะผู้เข้าสอบของตน

นอกจากนี้ เราอาจเปิดเผยข้อมูลส่วนบุคคลของท่านให้แก่ผู้จัดการแข่งขันในต่างประเทศตามรายการที่ท่านสมัคร (ดูข้อ 4)

4. การโอนข้อมูลไปต่างประเทศ

ผู้ให้บริการบางรายมีเซิร์ฟเวอร์ต่างประเทศ การโอนใช้กลไกตามกฎหมาย (เช่น SCC หรือฐานยกเว้นตามมาตรา 28-29) สำหรับรายการที่มีรอบ/ค่าย/การตัดสินในต่างประเทศ จะใช้รูปแบบใดรูปแบบหนึ่งตามแต่ละรายการ (รายการ/รูปแบบอาจเปลี่ยนเป็นระยะ): (ก) สมัครผ่านเรา — เราส่งข้อมูลเท่าที่จำเป็น (เช่น ชื่อ, อีเมล, โรงเรียน, ระดับชั้น, คะแนน/ผล) ไปยังผู้จัดในต่างประเทศโดยมีฐานทางกฎหมาย (ความยินยอม และ/หรือความจำเป็นต่อบริการ) ประกาศฯ นี้ครอบคลุม (ข) สมัครโดยตรงกับผู้จัด — ท่านกรอกข้อมูลที่เว็บไซต์ทางการของผู้จัดเอง เราไม่ได้ส่งข้อมูล กรณีนี้อยู่ภายใต้นโยบายของผู้จัดรายนั้นและกฎหมายของประเทศนั้น ไม่ใช่ประกาศฯ นี้ — รวมถึงการสอบออนไลน์บนแพลตฟอร์มของผู้จัด (เช่น ระบบ auto-proctored ที่ใช้กล้อง ไมโครโฟน แชร์หน้าจอ): ภาพ/เสียงระหว่างสอบถูกเก็บโดยผู้จัดภายใต้นโยบายของผู้จัด เราไม่ได้บันทึกหรือเก็บสำเนา ผู้จัดต่างประเทศแต่ละรายเป็นผู้ควบคุมข้อมูลอิสระภายใต้นโยบาย/กฎหมายของตนเอง ปลายทางอาจมีมาตรฐานต่างจากไทย กรณีเด็กไปร่วมกิจกรรมต่างประเทศ (เช่น ค่ายในจีน) เราจะขอความยินยอมจากผู้ปกครองก่อนทุกครั้ง เมื่อเราส่งมอบโดยมีฐานและแจ้งแล้ว การประมวลผลต่อจากนั้นของผู้จัดอยู่นอกเหนือความรับผิดชอบของเรา รายการและรูปแบบที่ใช้สอบถามได้

เราอาจโอนข้อมูลส่วนบุคคลของท่านไปยังผู้จัดในต่างประเทศเท่าที่จำเป็นต่อวัตถุประสงค์ที่เก็บรวบรวม โดยข้อมูลอาจถูกโอนไปยัง: ประเทศจีน, สิงคโปร์, อินเดีย, สหราชอาณาจักร และอิตาลี (ตามรายการที่สมัคร) กรณีปลายทางมีการคุ้มครองข้อมูลต่ำกว่าประเทศไทย เราจะดำเนินขั้นตอนที่เหมาะสมเพื่อให้ข้อมูลได้รับความคุ้มครองในระดับใกล้เคียงกัน ผ่านมาตรการอย่างใดอย่างหนึ่ง: ข้อสัญญาการประมวลผล/โอนข้อมูลที่มีมาตรการป้องกันเหมาะสมและบังคับใช้สิทธิเจ้าของข้อมูลได้ หรือความยินยอมของเจ้าของข้อมูล ตลอดจนฐานทางกฎหมายอื่นที่กฎหมายกำหนด

5. ระยะเวลาการเก็บรักษา

เราเก็บข้อมูลเท่าที่จำเป็น โดยทั่วไป 6 ปีหลังจบรอบการแข่งขัน (เพื่อครอบคลุมการแข่งขันต่อเนื่องตลอดช่วงชั้นประถม/มัธยม และการตรวจสอบผล-รางวัลย้อนหลัง) แล้วลบหรือทำให้ไม่ระบุตัวตน

6. สิทธิของท่าน

เข้าถึง, ขอสำเนา, แก้ไข, ลบ, ระงับใช้, คัดค้าน, ขอให้โอนย้าย และถอนความยินยอม — ติดต่อด้านล่าง เราดำเนินการภายใน 30 วัน

7. ความปลอดภัย

มาตรการทางเทคนิคและองค์กรที่เหมาะสมตามประกาศ สคส. ปี 2565 (การควบคุมการเข้าถึง, การยืนยันตัวตน, จำกัดสิทธิ์, บันทึกการเข้าถึง)

เรานำมาตรการความปลอดภัยเชิงเทคนิค เชิงบริหาร และการป้องกันทางกายภาพมาใช้อย่างเหมาะสม เพื่อป้องกันการเข้าถึง ใช้ เปลี่ยนแปลง เปิดเผยโดยไม่ได้รับอนุญาต หรือสูญหายโดยอุบัติเหตุ จำกัดการเข้าถึงเฉพาะผู้ที่ได้รับมอบหมายและจำเป็นต้องทราบ มีขั้นตอนรายงานและจัดการเหตุละเมิดข้อมูล และบุคลากรทุกฝ่ายรวมถึงผู้รับข้อมูลจากเรามีหน้าที่รักษาความลับตามมาตรการที่บริษัทกำหนด

8. การคุ้มครองผู้เยาว์

สำหรับเด็กอายุต่ำกว่า 20 ปี ต้องได้รับความยินยอมจากผู้ปกครอง หากพบว่าได้รับข้อมูลโดยไม่มีความยินยอมที่ถูกต้อง เราจะดำเนินการลบ

หากท่านเป็นผู้เยาว์ตามกฎหมายไทย ท่านต้องได้รับความยินยอมจากผู้ใช้อำนาจปกครองหรือผู้ปกครองตามกฎหมาย ก่อนให้ความยินยอมในการเก็บรวบรวมและประมวลผลข้อมูลส่วนบุคคลตาม PDPA

9. คุกกี้

เว็บไซต์ของเราใช้คุกกี้ที่จำเป็นต่อการทำงาน และอาจใช้คุกกี้เพื่อการวิเคราะห์ของแพลตฟอร์มผู้ให้บริการเว็บไซต์ (Wix) ท่านตั้งค่าหรือปฏิเสธคุกกี้ที่ไม่จำเป็นได้ผ่านแถบแจ้งเตือนคุกกี้บนเว็บไซต์หรือการตั้งค่าเบราว์เซอร์
